Terms of Service

Posted: January 22, 2026
Effective: January 22, 2026
Last Updated: October 16, 2026

These Terms of Service (“Terms”) are a binding agreement between Pageform, LLC (“Pageform,” “we,” “us,” “our”) and the person or entity accepting these Terms (“Customer,” “you,” “your”). These Terms govern your access to and use of the Pageform hosted platform, websites, applications, APIs, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and represent that you have read and understood them. If you do not agree, do not use the Services.

If you are using the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms. If you do not have that authority, you may not use the Services.

Order of precedence. If you enter into an order form, statement of work, or other written agreement signed by Pageform (“Order Form”), that Order Form controls to the extent it conflicts with these Terms. If there is a conflict between these Terms and any feature-specific terms or policies made available by Pageform for specific functionality, the feature-specific terms control for that functionality.

Exclusion of other terms. Any additional or different terms proposed by you (including in a purchase order, vendor portal, click-through, or procurement system) are rejected and void unless expressly agreed in writing by Pageform. Third-party terms (including app store terms) do not modify these Terms.

  • Viewer means a person who accesses Content via a shared link without a Pageform account.

2. Eligibility and Business Use

You must be at least 18 years old and legally capable of entering into binding agreements.

The Services are intended for business and professional use. You agree you are not using the Services primarily for personal, family, or household purposes.

3. Accounts, Organizations, and Security

3.1 Account Registration

You must provide accurate, current, and complete information. You must keep your account information up to date.

3.2 Credential Responsibility

You are responsible for safeguarding all authentication credentials and for all activity under your account and any accounts in your Organization, whether authorized or not.

3.3 Security Configuration Is Your Responsibility

You are solely responsible for:

  • configuring permissions, share link settings, gating, and NDA prompts

  • deciding what Content to upload and share

  • managing who has access (Users and Viewers)

  • maintaining secure devices, networks, and email accounts used to access the Services

Pageform is not responsible for unauthorized access caused by compromised credentials, phishing, forwarded links, misconfiguration, weak passwords, user error, or third-party compromise outside Pageform’s reasonable control.

3.4 Suspicious Activity

You must promptly notify us at [email protected] of suspected unauthorized access or security incidents involving your account.

4. Content, Ownership, and License

4.1 Ownership

You retain all rights in your Content. Pageform does not acquire ownership of your Content.

4.2 License to Operate the Services

You grant Pageform a limited, worldwide, non-exclusive license to host, store, process, transmit, display, and otherwise use your Content to provide, secure, maintain, and improve the Services and as permitted by these Terms, the Privacy Policy, and your settings. This license includes returning Content to an assistant you have authorized to access your account, as described in Section 9.1.

4.3 Your Responsibility for Content

You are solely responsible for your Content and represent and warrant that:

  • you have all rights and permissions needed to upload and share it

  • it does not violate law or third-party rights

  • you have complied with privacy and data protection obligations applicable to the Content

5. Data Processing Roles (Controller/Processor)

5.1 Roles

As described in the Privacy Policy:

  • Pageform acts as a controller for Personal Data processed for Pageform’s own purposes (account administration, billing, marketing, security, compliance).

  • Pageform acts as a processor/service provider when processing Content and Viewer analytics on behalf of Customers. In that context, the Customer/Organization is the controller.

5.2 Customer Instructions

These Terms (together with your feature settings and configurations) constitute your documented instructions to Pageform to process Content and related Viewer analytics to provide and secure the Services, to operate AI Features you invoke, to operate product analytics and AI observability as described in the Privacy Policy, to return Content to an assistant you connect under Section 9.1, and to comply with applicable law.

These instructions do not include using Customer Content to train models.

5.3 Legal Compliance

You are responsible for determining whether the Services are appropriate for your compliance requirements and for implementing configurations and processes to comply with applicable law, including retention, deletion, notices, consent, and lawful basis.

6. Viewer Gating, NDA Prompts, and Analytics

If you enable Viewer email gating, NDA prompts, or similar features, you acknowledge:

  • Pageform may collect Viewer identifiers (such as email) on your behalf

  • Pageform may log access/engagement analytics and make them visible to you and your Organization

  • You are responsible for the text and enforceability of any NDA, notice, or gating language you present to Viewers. Pageform does not provide legal advice.

  • Viewers may still copy, screenshot, screen-record, download (if enabled), or otherwise disclose Content outside the Services. You assume this risk.

7. AI Features and Automated Processing

7.1 AI Outputs Are Not Guaranteed

AI Features may produce inaccurate, incomplete, or misleading outputs. You are responsible for reviewing and validating outputs before relying on them. The same applies to output shown in a third-party assistant. Pageform does not control that assistant and does not warrant its output.

7.2 Third-Party Providers

AI Features may use third-party subprocessors, including:

  • Microsoft Azure (Azure AI Foundry and Azure Document Intelligence)

  • Google Cloud Vertex AI (Gemini models)

Use of AI Features may require transmitting portions of Content to such providers solely to perform requested functionality. Pageform also uses PostHog to record product analytics and truncated AI traces, as described in the Privacy Policy.

AI Features operate only on Content you choose to upload or make available within the Services. Pageform does not use Customer Content to train Pageform models, models for other customers, or third-party foundation models. Customer Content processed through Microsoft Azure AI Foundry and Google Cloud Vertex AI is not used to train shared generative AI models and is not made available to the underlying model providers for training.

7.3 No Liability for AI Outputs

To the maximum extent permitted by law, Pageform is not liable for any harm, loss, or damages arising from AI outputs, including decisions made based on AI outputs, misclassification, incorrect extraction, or omissions.

8. Acceptable Use

You will not, and will not allow others to:

  • upload malware, ransomware, or malicious code

  • probe, scan, or test the vulnerability of the Services

  • bypass access controls or plan limits

  • reverse engineer the Services

  • scrape, harvest, or bulk-collect data (including Viewer emails) except as enabled by the Services for your legitimate use

  • use the Services unlawfully or in violation of privacy, export, or sanctions laws

We may suspend or terminate access immediately for suspected abuse or security risk.

9. Third-Party Services

The Services may integrate with or link to third-party services (e.g., payment processors, email delivery, AI providers). Those third parties are not controlled by Pageform.

Pageform is not responsible for third-party services, their availability, their security, or their acts/omissions. Your use of third-party services is governed by their terms.

9.1 Connected Assistants

You may connect your Pageform account to a third-party assistant, including ChatGPT and Claude. If you do:

  • You authorize that assistant to use your account within the permissions shown when you approve the connection.

  • You are responsible for what you ask it to do, including confirming a change or a deletion before it runs.

  • The assistant’s terms and privacy policy govern the chat. These Terms govern your Pageform account and Content.

  • Pageform is not responsible for the assistant’s availability, security, or use of information after Pageform returns it.

  • Removing the connection in that product stops new requests. It does not delete Content already stored in the Services.

10. Fees, Subscriptions, Renewals, and Taxes

10.1 Billing

If you purchase a paid plan, you authorize Pageform (and our payment processor) to charge your selected payment method for recurring fees, usage-based fees (if applicable), and taxes.

10.2 Renewals

Subscriptions renew automatically unless canceled before the renewal date. Fees are charged in advance unless otherwise stated.

10.3 No Refunds

Fees are non-refundable except where required by law or explicitly stated by Pageform in writing.

10.4 Taxes

Fees exclude taxes. You are responsible for applicable taxes, duties, and similar governmental assessments, excluding taxes based on Pageform’s net income.

11. Confidentiality

11.1 Treatment of Content

Pageform will treat Content submitted to the Services as confidential and will not access, use, or disclose such Content except:

  • as necessary to provide, operate, maintain, secure, and improve the Services

  • to comply with applicable law, regulation, legal process, or lawful governmental request

  • to enforce these Terms, investigate violations, or protect the rights, safety, or property of Pageform, its users, or others

  • with your express direction or consent

Pageform stores and processes Content solely to provide data room functionality, including rendering, analytics, and AI-enabled features. Access to Content is limited to what is necessary to operate and support the Services in accordance with these Terms.

11.2 Limited Internal Access

Access to Content by Pageform personnel is limited to authorized individuals who require access for operational, security, support, or legal purposes and who are subject to confidentiality obligations.

11.3 Subprocessors

Pageform may use third-party service providers (for example, cloud hosting or payment processors) to support the Services. Such providers may process Content solely for the purpose of providing services to Pageform and are contractually obligated to protect it.

Pageform maintains a list of subprocessors in the Privacy Policy (Section 6.2). We will update that list when we add or replace a material vendor.

11.4 Customer Responsibility

You are responsible for managing access controls, permissions, Viewer settings, link sharing configurations, and email gating features. Pageform is not responsible for disclosures resulting from your configuration choices, link forwarding, user actions, or authorized Viewer activity.

12. Backup and Data Retention

You are responsible for backing up and retaining your Content. Pageform stores Content to provide the Services and may apply retention or deletion policies based on your plan, account status, or system requirements.

Upon account deletion or written request, Pageform will delete Customer Content within a commercially reasonable timeframe, subject to legal obligations and standard backup retention policies. Certain residual copies may persist temporarily in backups but will not be actively used.

To the maximum extent permitted by law, Pageform is not liable for any loss, corruption, deletion, destruction, or failure to store any Content.

13. Security Disclosures and Breach Risk Allocation

Pageform implements commercially reasonable technical and organizational measures designed to protect Customer Content, including encryption in transit and at rest, access controls, and monitoring.

You acknowledge:

  • no system is perfectly secure

  • the Services may be subject to cyberattacks, unauthorized access, and other security incidents

  • Pageform uses commercially reasonable safeguards but does not guarantee that Content, Viewer data, or analytics will never be accessed, altered, disclosed, or destroyed by unauthorized parties

Risk allocation

To the maximum extent permitted by law, Pageform will not be liable for any losses, damages, claims, costs, fines, penalties, or liabilities arising from:

  • security incidents, breaches, or unauthorized access

  • disclosure of Content through Viewer actions (including screenshots/recordings)

  • credential compromise, phishing, or social engineering

  • misconfiguration of permissions, links, or gating settings

  • third-party infrastructure/provider incidents outside Pageform’s reasonable control

Notification

If Pageform becomes aware of a security incident involving Personal Data for which Pageform is the controller, Pageform will take commercially reasonable steps and provide notice where required by law. For incidents involving data processed on your behalf (processor context), Pageform will provide notice consistent with applicable law and commercially reasonable practice.

Nothing in this section limits liability that cannot be limited under applicable law (for example, liability arising from willful misconduct where non-waivable).

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAGEFORM DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND DATA INTEGRITY.

PAGEFORM DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE PRESERVED WITHOUT LOSS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • PAGEFORM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES

This limitation applies to all theories of liability (contract, tort, negligence, strict liability, or otherwise) and even if a remedy fails of its essential purpose.

16. Indemnification

You will indemnify, defend, and hold harmless Pageform and its owners, officers, directors, employees, and agents from any claims, damages, losses, liabilities, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • your Content

  • your violation of law or third-party rights

  • your breach of these Terms

  • your sharing and access configurations

  • your failure to provide required notices/consents to Viewers or others

  • disputes between you and your Viewers or users

17. Termination

You may cancel at any time through the Services or by contacting support, subject to your plan’s billing cycle.

Pageform may suspend or terminate access immediately if:

  • you breach these Terms

  • we reasonably determine your use presents a security risk

  • required by law

Upon termination, your access ends. Pageform may delete Content consistent with the Services and retention practices. Pageform is not liable for deletion after termination.

Either party may bring claims in small claims court if eligible.

18.7 Survival

This section survives termination.

19. Governing Law and Venue

These Terms are governed by Florida law, excluding conflict of law rules.

For disputes not subject to arbitration, you consent to exclusive venue and jurisdiction in state and federal courts located in Florida.

20. Force Majeure

Pageform is not liable for delays or failures due to events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, internet disturbances, cloud provider outages, and cyberattacks.

21. Assignment

You may not assign these Terms without Pageform’s prior written consent. Pageform may assign these Terms without restriction.

22. Severability

If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in effect.

23. No Third-Party Beneficiaries

These Terms do not create third-party beneficiary rights.

24. Changes to Terms
